									<p>The National Restaurant Association of India (NRAI) has highlighted the issue of the absence of input tax credit (ITC) for the restaurant industry to the Union finance ministry. Currently, restaurant services attract a 5% GST without ITC. The industry is advocating for an optional structure allowing for the collection of ITC at a higher rate of 12%, alongside the existing structure.</p><p>“We don’t get GST input tax credit. We have written to the finance ministry. There is a budget coming up. For the next six months, we are meeting all the finance ministers across states and we are also meeting the finance minister of Bengal very soon. I am hopeful that the GST Rate Rationalisation Committee will look into this,” an industry expert stated.</p><p>“Without GST input tax credit, we are experiencing double taxation. For instance, when paying rent, we are charged 18% GST and then collect 5% GST from consumers, which we pay to the government,” the expert explained.</p><p>Restaurant operators emphasize this issue as main street rentals have increased across major cities, including Calcutta. The restaurant industry, valued at ₹5.69 lakh crore, contributes 1.9% to India’s GDP. The NRAI estimates this will grow to ₹7.76 lakh crore by 2028. The industry’s tax contribution was ₹33,809 crore in 2024, projected to reach ₹55,594 crore by 2028.</p><p><strong>State Excise Concerns</strong></p><p>NRAI members are set to meet Bengal excise officials to discuss various issues, including allowing restaurants and standalone outlets to serve liquor on dry days, high label registration fees, and increased duties on craft and draught beer.</p><p>“We are hopeful of a meeting with the excise department officials in August,” another industry expert mentioned.</p><p>“For this industry to thrive, it must include both food and beverage,” he added. Currently, liquor label registration fees vary nationally from ₹1,500 to ₹15,000, while in Calcutta, it stands at ₹50,000 per label per year. The association is seeking a reduction. Additionally, the duty on draught beer has surged from ₹12 to ₹200 over the past two years, prompting the association to request a review. While 5-star hotels are exempt from dry day rules, the association is calling for parity, allowing standalone bars to serve liquor on dry days.</p><p>The association also urges that all listed brands be available at Bevco warehouses to prevent stock shortages at the retail level.</p>								</div>

An October 2023 notification enforced this, making GST applicable at a rate of 18% on corporate guarantees between parent companies and subsidiaries, as well as other related parties.</p><p>Following this enforcement, several infrastructure firms, including real estate and power companies, filed writ petitions challenging the 18% levy. According to an official source, 50-60 such companies have received tax notices since the GST Council&#8217;s decision in late October to tax these guarantees, with aggregate tax demands exceeding Rs 1,000 crore. Notable companies receiving these notices include DLF, IL&amp;FS, Indiabulls Real Estate, and Supertech.</p><p>On Saturday, the Council proposed an amendment to Rule 28(2) of the CGST Rules, 2017, stating that valuation under these rules would not apply in cases of exporting such services (e.g., guarantees for a foreign subsidiary) and where the recipient is eligible for full input tax credit.</p><p>An expert noted that this amendment could ease compliance and record-keeping burdens and reduce fund blockages in certain cases. However, the amendment will still apply in situations where full input tax credit is unavailable to the recipient, leaving sectors like power and real estate seeking a reduced rate of deemed valuation.</p><p>Another expert pointed out that the two criteria do not include power and real estate companies, meaning their demand for exemption remains unmet. &#8220;Until the fine print of the amendment is released, we cannot conclusively say that the latest decision addresses the concerns of these sectors,&#8221; he added.</p><p>Many companies, particularly in the energy and real estate sectors, establish special purpose vehicles (SPVs) for each project. For funding purposes, the main entity must provide guarantees to financial institutions to secure funding for these SPVs. The industry argues that providing guarantees is not a benefit or service supplied to their SPVs but a &#8220;necessity&#8221; for SPVs to remain operational. As SPVs are newly established, raising funds is challenging, necessitating guarantees from Indian holding companies.</p></div></div></div></div>								</div>

									<p>Finance Minister Nirmala Sitharaman announced on Saturday that the central government intends to include petrol and diesel under the GST framework, leaving the decision on the tax rate to the states. She explained that former Finance Minister Arun Jaitley had already included petrol and diesel in the GST law, and now the states need to convene to determine the appropriate rate.</p><p>&#8220;The GST, as envisioned by my predecessor Arun Jaitley, was meant to include petrol and diesel. It is now up to the states to decide on the rate. The intent has always been clear; we want these fuels under GST,&#8221; Sitharaman stated.</p><p>Since the introduction of GST on July 1, 2017, which replaced numerous central and state taxes, five commodities – crude oil, natural gas, petrol, diesel, and aviation turbine fuel (ATF) – were included in the GST law but were to be taxed later. Currently, the central government levies excise duty on these products, while state governments impose VAT. These taxes, especially excise duty, have been increased periodically.</p><p>Sitharaman emphasized that the Central Government&#8217;s intent during the implementation of GST was to eventually bring petrol and diesel under this tax regime. &#8220;The provision for including these fuels in GST has been made. The only remaining step is for the states to agree on a rate within the GST Council,&#8221; she added.</p><p>She further explained that once the states agree on the rate in the council, the decision will be formalized in the Act. Bringing oil products under GST would allow companies to offset the tax paid on inputs and ensure uniform taxation on fuels across the country.</p>								</div>

									<p>More measures are needed to weed out fake input tax credit (ITC) generators from the system for checking tax evasion and increasing GST revenues, CBIC member Sanjay Kumar Agarwal said on Wednesday. He said the government has taken various steps to tackle the menace of fake ITC claims and has already launched a special 2-month-long drive to identify fake registrations under Goods and Services Tax (GST) and nab offenders.<br />“If we make seeding of fake ITC impossible or very very difficult, then the problem will get nipped in the bud. Towards this end, the recent validations have been introduced… There is still something more…to be done to weed out fake ITC generators from the system,” Agarwal said at a PHDCCI event here. He said that the registration under GST has soared to 1.39 crore taxpayers, from 64 lakh in the erstwhile excise and service tax regime. Many unscrupulous elements have entered the GST system to claim ITC on the basis of fake invoices, he said, adding that “the struggle of tax administration is how to eliminate them, and make the system pure again”.<br />Goods and Services Tax (GST), which subsumed over a dozen indirect tax levies of the Centre and states, was implemented on July 1, 2017. GST evasion has crossed Rs 1 lakh crore in 2022-23 fiscal, up from Rs 54,000 crore 2021-22 fiscal. The total number of evasion cases is also on a rise with about 14,000 cases detected in 2022-23, up from 12,574 cases in 2021-22 and 12,596 cases in 2020-21. Earlier this month, the GST Policy Wing had written to Principal Chief Commissioners of Central Tax highlighting that fake/ non-genuine registrations are being used to fraudulently pass on input tax credit to unscrupulous recipients by issuing invoices without any underlying supply of goods or services or both.<br />During the ‘Special All-India Drive’ from May 16 to July 15, to detect suspicious/ fake GSTINs, Central and state tax officers are conducting requisite verification and taking further remedial action to weed out these fake billers from the GST eco-system. GST Network will identify fraudulent GSTINs for state and Central tax authorities and share the details jurisdiction wise, with the concerned state/ Central tax administration for initiating verification drives and conducting necessary action subsequently.</p>								</div>
