This decision comes following concerns raised regarding participation in the exchange-traded currency derivatives (ETCD) market in light of the RBI&#8217;s currency derivative norms.</p><p>The RBI emphasized that the regulatory framework for ETCDs has remained consistent over the years and that there is no change in the RBI&#8217;s policy approach. This extension was made after considering feedback and concerns from various stakeholders.</p><p>According to a circular issued on January 5, investors must ensure the existence of a valid underlying contracted exposure, which has not been hedged using any other derivative contract. They should also be able to establish the same if required. The term &#8220;underlying&#8221; in derivatives contracts refers to the order bill or receipt for exporters and importers, or documents supporting the transaction in the case of remittances.</p></div></div></div></div></div></div></div></div></div></div></div></div>								</div>

									<p><strong>In a bid to offset some of the impact on their margins hit by the 28% Goods and Services Tax (GST), over four months after it came into effect on October 1, the online gaming industry is looking to innovate and even incentivise users.</strong></p><p>“Operating costs of gaming companies have increased by 4x to 6x times after the implementation of 28% GST on deposits. Companies are trying to offset this increased cost by reducing their marketing budgets, laying off employees and adoption of other cost-cutting measures at different levels to survive,” one of the expert said.</p><p><strong>As per reports, major industry players have already started providing special cashback offers and incentives to offset the GST burden on players. Some of them are also looking to put more money into advertisements and create new users to increase profitability. Witzeal Technologies, too, is “looking for other innovative models on the product side to provide a cutting-edge gaming experience to our users by enhancing our existing games and introducing other innovative things to increase user engagement”, he said without giving further details.</strong></p><p>Another expert said that the industry players are also introducing new variations in their gaming models to keep consumers hooked. “Another option that they may explore is to introduce games with a low-entry threshold and with a wide player base to ensure that the consumer is not impacted by the quantum of tax suffered,” he added.</p><p><strong>In the backdrop of the 28% GST implementation, there are two strategic options that online gaming companies are exploring at this stage, as per Kishore Kumar, lead, GST and customs, Taxmann Allied Services. “These are to absorb the entire GST liability of 28% or pass on the burden partially or completely to the users. In addition, companies are considering innovative strategies to enhance spin rates, reduce customer acquisition cost and improve unit economics,” he said.</strong></p><p>According to an industry expert, gaming operators are working to determine the best business model and opportunities for innovation to rebuild the foundation of gaming in India under the new GST regime. “Online gaming is an emerging sector that will offer the growth that Bharat deserves in our Amrit Kaal,” he said, adding: “The process for the government and the industry to find a balance is ongoing. The government would find a balance between providing a boost to the industry and maximising its revenue.”</p><p>Meanwhile, the aggressive taxation regime has provided impetus for companies to diversify operations into other geographies that provide them lower tax base. For example, in October, gaming startup WinZO announced that it is investing $25 million to expand its base in the Brazilian market, where the tax levy is much lower than in India and stands at 2-5%.</p><p>Brazil is the fourth largest gaming market in the world with a user base of 90 million users. The expansion is particularly timely in the context of challenges faced by India’s gaming ecosystem due to a 400% increase in the GST, another expert was quoted as saying by media reports then.</p>								</div>

									<p>The Ministry of Micro, Small and Medium Enterprises implements various schemes and programmes aimed at support and development of MSME Sector in the country in areas of credit support, new enterprise development, formalization, technological assistance, infrastructure development, skill development and training and market assistance to MSMEs. These schemes/programmes include MSME Champions Scheme, Credit Guarantee Fund Trust for Micro and Small Enterprises (CGTMSE), Prime Minister’s Employment Generation Programme (PMEGP), Micro and Small Enterprises – Cluster Development Programme (MSE-CDP) and Raising and Accelerating MSME Performance (RAMP).</p>								</div>

									<p>The Udyam Registration Portal was launched on 01.07.2020 to facilitate ease of registration for MSMEs and access to all the Schemes and benefits. The registration process is free of cost, paperless and digital. As on 05.02.2024, more than 3.64 crore MSMEs with an employment of more than 16.86 crore, have registered on Udyam Portal (this includes the Informal Micro Enterprises (IMEs) registered on Udyam Assist Platform (UAP)). The Government has also launched Udyam Assist Platform on 11.01.2023 to bring Informal Micro Enterprises (IMEs) under the formal ambit for availing the benefits under Priority Sector Lending. He clarified that the review will not occur during the upcoming meeting due to the expiry of the six-month period on March 31, suggesting that it may be addressed in subsequent gatherings, likely later in February.</p>

									<p>Revenue Secretary Sanjay Malhotra announced that the GST Council will reconsider the imposition of a 28 percent Goods and Services Tax (GST) on the full face value of online gaming, but not until after March 31. He clarified that the review will not occur during the upcoming meeting due to the expiry of the six-month period on March 31, suggesting that it may be addressed in subsequent gatherings, likely later in February.</p><p>Malhotra emphasized that a review does not necessarily entail altering the rates, but rather aims to assess the situation and determine if any adjustments are warranted. The GST Council had previously increased the tax rate on online gaming from 18 percent to 28 percent on the full face value, effective October 1, 2023, resulting in a significant surge in revenue from the sector.</p><p>The Revenue Secretary highlighted that the government stands to gain a substantial portion of GST revenue from online gaming if the current tax rate remains unchanged. He projected GST revenue of over Rs 7,000 crore in FY24 and Rs 14,000 crore in FY25, compared to Rs 1,600 crore in 2022-23. Malhotra noted that since the implementation of the revised tax rates three months ago, GST revenue from online gaming companies has surged from Rs 605 crore to Rs 3,470 crore, translating to an annual addition of approximately Rs 12,000 crore.</p><p>Under the revised tax regime effective October 1, 2023, a 28 percent GST is applicable on the face value of every deposit made by a player on an online gaming platform. Importantly, the taxation is based on the deposit duration rather than the gaming time. If the same amount is deposited multiple times in a month, the tax is levied each time, resulting in a high tax incidence.</p>								</div>

									<p>The Institute of Chartered Accountants of India (ICAI) has issued new Continuing Professional Education (CPE) Credit Guidelines for Chartered Accountants (CAs) for the year 2024.</p><p>The Continuing Professional Education Committee (CPEC), an integral non-standing committee guided by the ICAI Council, plays a crucial role in overseeing CPE activities conducted by Programme Organising Units (POUs) and individual members. The committee operates with a constructive approach, offering comprehensive training programs outlined in an extensive CPE calendar.</p><p>Recognizing the significance of maintaining high-quality standards in professional services and competence, ICAI has focused on Continuing Professional Education (CPE) since 2003. The Statement on Continuing Professional Education, 2003, set norms for members undertaking CPE activities, with subsequent amendments leading to its applicability until the enforcement of the CPE Statement, 2023.</p><p>Adapting to the evolving business landscape and global practices, the ICAI Council, through the CPE Committee, regularly issues or revises CPE Advisories/Guidelines in accordance with Section 15 of the Chartered Accountants Act, 1949.</p><p>Under the powers conferred by the Chartered Accountants (Amendment) Act, 2022, the ICAI Council, during its 426th meeting, introduced the &#8220;Statement on Continuing Professional Education, 2023.&#8221;</p><p>This statement outlines the mechanisms for members to undergo CPE activities and includes provisions for non-compliance with CPE hours&#8217; requirements, applicable from the Calendar Year 2024. Consequences for non-compliance come into effect from January 1, 2025, for issues arising in the Calendar Year 2024. </p>								</div>

The government aims to transform the country into a developed nation by 2047.</p><p>Key points from the budget speech include:</p><ul><li>-The revised estimate of fiscal deficit stands at 5.8% of GDP.</li><li>-The government highlighted the transformative journey over the last decade under the &#8220;Sabka Sath, Sabka Vikas&#8221; mantra.</li><li>-Direct benefit transfers of Rs 34 lakh crore through PM Jan Dhan accounts resulted in savings of Rs 2.7 lakh crore by eliminating leakages.</li><li>-Emphasis on the poor, women, youth, and farmers as priority groups.</li><li>-The Skill India Mission trained 1.4 crore youth and established various educational institutions.</li><li>-GST has facilitated a unified market and tax system.</li><li>-The average real income of people increased by 50%.</li><li>-Despite Covid challenges, the PM Awas Yojana Rural continued, targeting 3 crore houses, with plans for an additional 2 crore houses in the next 5 years.</li><li>-Seafood exports doubled, and the India Middle East Europe Economic Corridor is anticipated to be a game-changer.</li><li>-The government plans to increase defence outlay by 11.1% to Rs 11,11,111 crore.</li><li>-Infrastructure development includes converting 40,000 rail bogies to Vande Bharat standards, doubling airports to 149, and Indian carriers ordering 1,000 new aircraft.</li><li>-A Rs 1 lakh crore corpus with a 50-year interest-free loan for tech-savvy youth aims to boost research and innovation.</li><li>-Rs 34 crore Mudra Yojana loans have been given to women entrepreneurs.</li><li>-The FY25 GDP growth is projected at around seven percent.</li></ul><p>Fiscal details:</p><ul><li>-Revised estimate for total receipts (excluding borrowing) is Rs 27.56 lakh crore, with tax receipts at Rs 23.24 lakh crore.</li><li>-FY25 fiscal deficit pegged at 5.1%, aiming to reduce it below 4.5% by FY26.</li><li>-Gross market borrowing for FY25 is set at Rs 14.13 lakh crore.</li><li>-Tax benefits for startups and extended investment incentives.</li><li>-Tax rates for direct and indirect taxes remain unchanged.</li></ul><p>The government&#8217;s focus is on boosting domestic consumption, reducing rural stress, generating employment, and easing compliance burdens. In the pursuit of a developed India, the full budget will provide a detailed roadmap. The FY25 GDP growth target aligns with the RBI&#8217;s projections, with cautious optimism about economic performance. The total expenditure in Budget 2023-24 reached Rs 10 lakh crore, with the highest-ever capital outlay of Rs 2.40 lakh crore allocated to Railways.</p>								</div>

									<p>Finance Minister Nirmala Sitharaman is gearing up to present a Vote-on-Account or Interim Budget for 2024. Despite signaling a lack of &#8220;spectacular announcements,&#8221; real estate stakeholders remain hopeful that some of their key demands may be addressed. These demands include an increase in the home loan interest deduction limit, a revision in the definition of affordable housing, and the grant of industry status for the real estate sector.</p><p>One significant expectation is the raise in the deduction limit for home loan interest payments under Section 24B. The current limit of Rs 2 lakh annually, unchanged since 2014, is proposed to be elevated to a minimum of Rs 5 lakh. Industry experts argue that this adjustment is crucial to stimulate housing demand, particularly in the affordable housing segment, given the rise in property prices and higher borrowing amounts by homebuyers.</p><p>Affordability concerns in home buying, especially in metros, have led to demands for the reintroduction of incentives and the update of affordable housing definitions. Sales in the affordable category have seen a decline, and experts urge the government to announce measures, such as tax breaks, to encourage developers to construct more affordable housing. Standardizing affordable housing definitions across government and financial institutions is also recommended to maximize benefits for buyers.</p><p>Regarding the definition of affordable housing, experts suggest that a blanket price cap is inappropriate. The threshold for affordable housing is proposed to be increased to Rs 85 lakh for metropolises like Mumbai and Rs 60–65 lakh for other large cities. Granting industry status to the real estate sector is another longstanding demand from the supply side, aiming to simplify processes for developers and provide additional advantages.</p><p>The rationalization of capital gains tax is also highlighted, with a recommended reduction in the prevailing 20 percent capital gains tax to incentivize investments and foster economic growth. Simplification in the capital gains structure is desired by retail investors for further clarity. Overall, stakeholders are optimistic that the Interim Budget for 2024 will address these concerns and provide much-needed support to the real estate sector.</p>								</div>

									<p>Companies such as Google, Facebook, and X (formerly Twitter), along with some edtech firms, could be subject to an Integrated Goods and Services Tax (IGST) of up to 18 per cent on services provided to the government and individuals in India, effective from October 1, 2023.</p><p>This development follows a notification issued by the Central Board of Indirect Taxes and Customs, stating that these services will no longer enjoy an exemption from IGST, according to a report in The Economic Times.</p><p>A senior official commented, “This will cover overseas companies providing advertising, cloud services, music, subscription-based services, online education, and even information to all individuals and government, regardless of whether the services are used for personal or business purposes.”</p><p>Previously, services from Online Information Database Access and Retrieval (OIDAR) providers located in non-taxable territories and received by the central government, state government, government authorities, or individuals for purposes other than business were exempt from taxation. Taxes were applicable only to business-to-business (B2B) services.</p><p>One expert noted, “This amendment specifies that the said exemption entry will no longer apply to OIDAR services starting from October 1, 2023. Consequently, OIDAR services provided to the aforementioned persons are now liable to taxation.”</p><p>OIDAR services, delivered via information technology over the internet, are automated and involve minimal human intervention. Such services encompass advertising on the internet, cloud services, sale of e-books, films, music, and software, digital content supply, data storage, and online gaming.</p><p>The official further clarified that the notification would eliminate any ambiguity resulting from the amendment introduced in the Finance Act 2023, as individuals and government entities were previously exempt.</p><p>Experts have, however, pointed out that this move could heighten compliance requirements for smaller companies and adversely affect many edtech and subscription based service providers.</p>								</div>
