In the complex landscape of taxation, Advance Pricing Agreements (APAs) play a pivotal role in providing clarity and certainty to taxpayers, especially in the domain of transfer pricing. Recently, the Central Board of Direct Taxes (CBDT) made headlines by signing a record number of 125 APAs in the financial year 2023-24, marking a significant milestone in India’s tax administration.

Record Number of APAs Signed by CBDT in FY 2023-24

This remarkable achievement by the CBDT encompasses a total of 125 APAs, consisting of 86 Unilateral APAs (UAPAs) and 39 Bilateral APAs (BAPAs). This represents the highest number of APA signings in any financial year since the inception of the APA programme. Moreover, it reflects a notable 31% increase compared to the 95 APAs signed in the previous financial year.

Types of APAs: Unilateral and Bilateral

Understanding the distinction between Unilateral and Bilateral APAs is crucial in comprehending the scope and impact of these agreements. Unilateral APAs involve agreements between the taxpayer and the tax authority of a single jurisdiction, whereas Bilateral APAs are negotiated between the taxpayer, the tax authority of the home country, and the tax authority of the foreign jurisdiction involved in the transaction. Both types of APAs serve the purpose of providing certainty and clarity in transfer pricing arrangements.

Impact of APAs on Tax Certainty for Taxpayers

The APA Scheme offers taxpayers the advantage of foreseeing and determining the arm’s length price of international transactions in advance for up to five future years. Additionally, taxpayers have the option to rollback the APA for four preceding years, thereby extending the duration of tax certainty to nine years. This proactive approach not only mitigates the risk of double taxation but also enhances confidence and compliance among taxpayers.

Role of APAs in Promoting Ease of Doing Business

The significant uptick in APA signings underscores the vital role played by these agreements in fostering a conducive business environment. Particularly for Multi National Enterprises (MNEs) engaged in extensive cross-border transactions, APAs offer a structured framework for conducting business operations with clarity and predictability.
